Revealing details about the legal case against Nawazuddin Siddiqui’s family, Aaliya’s lawyer, Advocate Rizwan Siddiquee told ETimes, “The first case that was filed was a counter case to their complaint. We have filed it under section 509, insult to modesty. The basis of that is very simple. Nawazuddin’s mother claims that Aaliya is not his wife, in her complaint. So, in this scenario, this statement has to come from Nawaz and not from the mother. If Nawaz claims that Alia is not his wife, then it is contrary to all the documents where he has declared Aaliya as his wife, which includes government documents, passport and interviews. He admits they have two children between them, even on the passports and even on the birth certificates, there is no denial. But the mother claims that there is no relationship. Nawaz is being tight-lipped all this while.”
Rizwan went on to detail the implications of these allegations and added, “So if the mother is right and Nawaz is wrong, then it is a case of rape against Nawazuddin Siddiqui. Because, if you deceitfully make a lady believe that you are her husband and have any kind of sexual intercourse by making her falsely believe that you’re a husband, then it is a case of rape. Because Nawaz is keeping quiet about it, I’m not initiating any rape complaint against him right now. And I’m going by the admission on paper by Nawaz that Aaliya is his lawfully wedded wife because that is what he says everywhere. And if this case is true, then there is no case of trespass, which can be made against Aaliya by her mother-in-law because she has got no right or liberty to fight any kind of trespassing case against a wife who is entering her own husband’s house. After CCTV cameras were installed, now even bodyguards are there, stopping Aaliya from going to a bathroom in the upper rooms. This means, their complaint of trespass is baseless and Nawaz is cornered from both sides. Either there is a rape case against him or there is a case of domestic violence, because she is not getting food, there is mental, physical, emotional and financial abuse.”
It has been over a week that Aaliya has been staying at Nawazuddin’s plush Andheri bungalow. But she alleged being deprived of basic amenities. Her lawyer shared, “We have video evidence of the last eight days where she’s not been allowed to sleep in a room. She’s been sleeping on a sofa, she does not have a bathroom to bathe in. They had stopped food initially, but now that the children are back from Dubai, Nawaz has made arrangements for food for the children. So she is eating with them whatever little is left. Therefore, cases with sections 498A and 509 are being filed. Aaliya’s mother-in-law has insulted the modesty of my client by challenging their relationship and the legitimacy of the children. That means you have called her a characterless woman and that is an insult to modesty and innumerable attempts are being made to remove Aaliya from the house.”
While there is buzz that Aaliya is stirring controversy for property gains, her lawyer revealed the real reason for her presence in Mumbai. He said, “Aaliya is not here for some property dispute. The basis of this entire thing is that my client’s young daughter was exposed to dangers by the father who made her travel with his male manager to Qatar. And made her stay in a room, outside the territory of Dubai without the knowledge of my client, who is the biological mother. So because he was endangering the security of the young daughter, my client went to confront him because he did not respond to my notices. The manager received my notice and even the husband has received my notice but they have never bothered to respond. They kept quiet and even threatened.” Hearing of all these cases is due in the coming days and Aaliya is positive things will work in her favour.
